During the hearing on same-sex marriage recognition, the country’s Chief Justice asked the Centre whether social security arrangements for homosexuals or transgender people had been made.

The federal government organised a committee to investigate the issues that gays and transgender individuals confront on a daily basis. Tushar Mehta, the Central Solicitor General, stated this in the Supreme Court on Wednesday. According to Mehta, this committee will be led by a cabinet secretary.

On April 27, Chief Justice DY Chandrachud asked the Centre if there were any social security or social security procedures in place for gays or transgender people.

Apart from that, the Chief Justice stated in his observation that if the Centre recognises same-sex couples’ cohabitation as a fundamental right, the government has a responsibility to them. In fact, it was at that time that Narendra Modi’s government decided to form a committee to investigate the concerns of gay and transgender individuals.

Homosexuals and transgender people are currently having difficulty creating a joint bank account or naming a nominee in an insurance or savings plan. The centre wants to know what other difficulties they confront on a regular basis. So far, the Centre’s position on same-sex marriage has been that the issue will be decided by the legislature. The judiciary cannot make a decision in this case.

During the April 27 hearing of this case, the Chief Justice told the Solicitor General that whether or not this marriage is recognised, the right to love and choose a sexual partner cannot be taken away.
